his BAC was 0.038. Half of legal limit. I'm sure he got a speeding ticket, but not DUI.

Seems a little sus though, if he blew a 0.038 that it would take 19 months to settle that. I'd call shenanigans if I didn't want the whole thing to just be over with haha.

Yeah, half the legal limit and they wrote him for DUI? On what grounds? There is zero chance that would stick with a fricking court appointed lawyer, let alone one and NFL player can hire! That's pretty fishy.

If you are driving erratically at 96mph and you smell like alcohol there is a good chance you are over the legal limit. Actually crazier that he did that given he wasn't drunk. Idiotic. Also the fridge that had his blood failed so who knows if it was accurate or not by the time they tested it. What a joke on every level.

“Those things will be worked out, but I’m extremely confident in all those things,” Smith said, via Brady Henderson of ESPN. “Those things, they have a timeline and they have to get worked out, but I don’t see any problem.”
And he was correct

Blaming the lab
The delay in the decision occurred because of a backlog of blood tests with the Washington State Patrol Crime Lab.

How many arrests have blood tests instead of the usual breathalyzers? 10%. Just inexcusable to have a back log. What do they have one person to do all the tests for the entire state? Once they start getting a back log don't they say hey we need more funding or just let it go??? Joke show/government at its finest.

There's more than just DUIs being tested. And I agree, no doubt they have pointed it out, idiot legislators obsessed with cutting costs

If he had refused the field breathalyzer, he would automatically be arrested for DUI. Then he could request a blood draw. All of that takes time, which helps lower the BAC. So maybe Geno was legit in his legal battle.
