You have that right! And there should be a way for recompense until the child is 18. But far too often, the guy is an idiot and doesn't carry a condom. Or the one he has has been in his wallet for the past seven years. It isn't as though the stuff is not readily available. It's people being stupid! And I know I was as a kid. And lucky, too!

I am torn, myself. But I want to put an end to the tennis ball we lob back and forth. Abortion is not in the Constitution, and thus not a "right." But there is a provision around that. Two actually. The first will never happen, but pro-abortion people could petition Congress to consider adding a Constitutional Amendment. Won't happen. You can't get enough states to ratify it.

Second, the 10th Amendment states that anything NOT mentioned in the Constitution reverts to the people and their respective States (basically, even with all of the bad connotations following it around) "States Rights." There is nothing that says the individual states cannot legalize abortion. Then the argument becomes, "Well the abortion clinic and travel to another state isn't convenient." And then we're back to the stupidity argument!

Good points, ddraig. And I think I read this week that even RBG wasn't too crazy about the sweeping nature of Roe V. Wade, having said she would have liked the ruling to stick more to the limited case presented to the court (apologies if I have that wrong, just going from memory). Anyway, yes, a constitutional amendment one way or the other would "settle" things, with a lot of unhappy people either way.

I like States Rights in principle, but aren't there many cases of the Federal government making laws, or the Supreme court making rulings, that overrule state law? I'm thinking of the "corporations are people" for example (Citizens United decision?) Or the federal prohibition on marijuana.

Look up what they did with Interstate Commerce. Those laws made sense. But so much has been attached to the Interstate Commerce laws that it's hard to understand how the Supreme Court could make some of the pronouncements they did using Interstate Commerce as an argument. I suppose that would be a third way to do it. Figure out how abortion could be Interstate Commerce.

When RBG said the Senate should "do their job" concerning the Merrick nomination, she forgot that The US Senate does not answer the the Supreme Court.........for anything. Just like the SC decides which cases to take and how to adjudicate them....none of the Senates business. Separation of powers.....its a good thing.

Dying in office is one thing, but hardly the case for sainthood. Political or legal careers are hard to let go of. The notion of being indispensable can blind the objectivity toward the responsibility. Sustaining the station becomes primal.

How about we go on with our lives and the political press quarantine themselves for a year.

Imagine being passionate about keeping abortion legal. I am ambivalent about it but I can't fathom dedicating my life to keeping it legal and freaking out whenever a pro life Judge might get nominated.
I am so tired of the political football that is abortion. Both sides don't wish to fix the problem because it gains them votes. They should be looking to fix the situation but the Dems and the Reps both like the situation the way it is. And it's relatively easy to fix. First, Congress should create a new, potential Amendment. Then send it to the States for ratification. The Dems don't like this option because they know the majority of States won't ratify it.

The other option is to take Roe v. Wade to the Supreme Court and have it ruled unconstitutional. But that doesn't make it illegal. The 10th Amendment states that what isn't contained in the constitution reverts to the people and the States. States like Washington, Oregon, and California can make abortion legal and the Feds have to stay out of it. Other States, Montana, South Dakota, Alabama, can rule it illegal.

But what about those poor women in those three states that can't get an abortion. Well, for on thing, they probably should have thought about having unprotected sex with Bubba BEFORE they went to the bar. It isn't like every pharmacy and grocery store isn't well stocked with condoms! And how hard is it to have your doctor prescribe a pill to prevent pregnancy in the first place? But the final kicker in my book is what does it cost to fly from Butte to Seattle or Spokane to get an abortion? $400. Not that much, but more than a case of condoms!

If she wanted a lib replacement she should have resigned in 2015 but couldn't give up that power.
